[Photo|Busia County Government]Busia Governor Sospeter Ojaamong wants the election petition case against him dismissed with costs.In his final written submissions presented by his lawyer Stephen Ligunya before trial Judge Kiarie Waweru Kiarie on Thursday, Ojaamong said the petition lacks merit and should bear the costs of the petition."In view of the foregoing, and taking into account the time spent and the volume of work involved, it is my humble submission that an order for a cap on instruction fees in the sum of Sh20 million payable by the petitioner, Peter Odima should be made," said Ojaamong."The court is aware that I was represented by a senior Counsel Dr Otiende Amollo from Nairobi and assisted by three Counsel. The Court should therefore issue a certificate of costs for a Senior Counsel and for three Counsel."The IEBC through lawyer Chrysostom Akhaabi has put their figure at Sh10 million, according to the governor, plus an additional getting up fee of Sh3.4 million. The petitioner on his hand capped his costs at Sh7 million.Ojaamong in his submissions said the petitioner Peter Odima, confirmed that they had no dispute with the results declared at each polling station. On their part, IEBC and County Returning Officer through lawyer Akhaabi, said the 3rd respondent was validly elected as the governor of Busia County in a free and fair election conducted in accordance with the constitution and the Election Law with minimum irregularities which had no effect on the outcome of the election.Odima in his submission claimed that there were malpractices and falsehood during the campaigns with Ojaamong's opponent, Dr Paul Otuoma falsely and maliciously linked to Jubilee Party and being branded a mole.The judge deferred the judgment of the case from February 5th to 12th due to circumstances beyond his control.
