Changamwe MP Omar Mwinyi was on Friday handed a reprieve after the Mombasa High Court validated his election.
While dismissing a petition filed by Mohammed Mahmoud Ali, a voter, Justice Njoki Mwangi said that the lawmaker’s win reflects the will of his people.
She also said that the claimed irregularities and illegalities. She said that irregularities cited in the petition are not huge enough to nullify the election of Mr Mwinyi.
The court also slapped the petition with a fine of Sh8 million for costs to be paid to the Independent Electoral and Boundaries Commission (IEBC) and MP following the dismissal of the election petition against the lawmaker.
The judge also dismissed claims that Mwinyi masterminded ethnic profiling during the August General elections, which gave him an upper hand over his competitors, adding that everyone was allowed to take part in the exercise “None of the voters identified were denied a chance to vote,” said Justice Mwangi said.
Through lawyer Gikandi Ngibuini, the petitioner said that he will appeal the ruling, adding that he does not agree with the decision of the High Court over the case.
Through lawyer Mohammed Ali, the MP told the court that he won the election in a free and fair manner while IEBC through lawyer Justus Munyithya insisted that the commission did not violate the constitution when conducting the exercise.
