Mombasa Governor Hassan Joho’s application seeking the court to quash an election petition filed against him is incompetent and bad in law, Former Senator Hassan Omar has said. Omar has maintained that the county boss has a case to answer in regard to the August 8 general election.In a sworn affidavit through his lawyer Paul Buti, Joho had sought for the termination of the case arguing that it is defective because his deputy William Kingi was not included.However, Omar, through his lawyer Yusuf Abubakar said that the deputy governor is a beneficiary of votes that the county boss garnered during the elections, Baraka FM has reported. Omar, who defected from Wiper following his loss, said that the dismissal of the case filed against Joho contravenes order 51 of the civil procedure rule, 2010.The vocal politician argued that the voters do not vote for the deputy governor, adding that he is not a beneficiary of the voting process. The petition seeking the dismissal of the case will be heard on October 9. Joho has however insisted that his win reflects the will of the people of Mombasa, adding that Omar needs to accept and move on.
