Former Law Society of Kenya chairman Okong’o Omogeni has warned Chief Justice nominee Justice David Maraga of the ‘tough’ test ahead of him which requires ‘courage and super judgments’.

Justice Maraga beat other experienced legal moguls among them US-based law Professor Makau Mutua and Supreme Court Judges Smokin Wanjala and Jackton Ojwang in the fierce contest.

Speaking to this reporter shortly after the nomination, Mogeni lauded Justice Maraga as an ‘incorruptible’ judge but insisted that ‘cartels’ in the Judiciary could make his work difficult.

“I have known Justice Maraga for a long time and I want first to congratulate him for the nomination. However, he knows that tough test ahead of him which will require courage and super judgments. Working in the Judiciary isn’t that easy,” said the senior counsel.

Mogeni added: “there are a lot of cartels in the Judiciary and I wish him all the best should he be appointed. They will always try to frustrate reforms and that is when he will be required to make tough decisions.”

Mogeni is on record for disowning the victory of retired President Mwai Kibaki in 2008 when he was chair of Law Society of Kenya and was subsequently denied the EACC job in 2012 despite emerging the best in interviews.
