Renowned activist Okiya Omtatah wants Kenya Revenue Authority commissioner general John Njiraini to be forced to go on terminal leave ahead of his retirement at the end of this year.
According to Omtatah, Njiraini will attain the mandatory retirement age on December 19 making his eligible for a six-month terminal leave.
He has argued that Henry Rotich is under the obligation of looking for Njiraini's replacement.
By failing to do so, Omtatah contends, Rotich has absconded on his duties, therefore, potentially offending the law.
The case filed by the controversial activist has been certified as urgent by Justice Mary Onyango who has instructed Omtatah to serve Njiraini and Rotich ccourt papers.
