The Supreme Court judgement does not confer legitimacy to President Uhuru Kenyatta election win, Prof Makau Mutua has said.
According to the US-based law scholar, Uhuru's rule in the next five years will be 'illegal' despite the top court declaring him validly elected.
"He (Uhuru) has been declared legally elected, but he is illegitimate. Only a Martian fool would celebrate the court's verdict. That is because the legality of an action doesn't amount to its legitimacy," he wrote in an article published by Sunday Standard.
Mutua said the October 26 fresh election was on no value after the withdrawal of NASA presidential candidate Raila Odinga and his running mate Kalonzo Musyoka.
"A free and fair election must be competitive. An election that is not competitive cannot be free and fair," he said.
"Imagine a US election that was boycotted by either the Democrats or Republicans. Anyone elected after the boycott would be totally illegitimate," added the Kenya Commission on Human Rights chairperson.
Mutua further accused Jubilee administration of threatening the IEBC to conduct the 'shambolic' poll despite the electoral commission boss Wafula Chebukati declaring he could not guarantee a credible election.
"It is only after Uhuru summoned a scared-looking Chebukati that he proceeded with the shambolic election. How could such a body conduct a legitimate poll?" he posed.
