Lawyer James Orengo says Supreme Court has no option other than to declare President Uhuru Kenyatta's victory 'null and void' based on the 'concrete' evidence before it.

For the second time within three months, Kenya's Supreme Court will determine the fate of a presidential petition before it.

"I have perused the content and I can tell you the petitioners have raised tangible questions that will lead to nullification," he said on Wednesday at Kisumu.

President Uhuru Kenyatta faces possibility of having his victory nullified twice within a short span, a move that will break world history.

And Orengo, who successfully prosecuted the previous case, says should intimidation of judges fail to prevail, they will have no option other than sending Kenya back to ballot.

"There were no nominations, some bankrupt candidates participated and we had malpractices all over," he said.

He further said: "Those are enough grounds and I am sure Supreme Court will give petitioners justice."

Ex- Kilome MP Harun Mwau is among the petitioners in a case that opposition was not keen to be part of it.

Uhuru was declared winner of October repeat polls having garnered over 98 percent of votes cast, in an election that was boycotted by his main challenger Raila Odinga.
