Senior Counsel James Orengo, who is appearing for Raila Odinga has extended his good outing in 2017 following landmark decision by Supreme Court judges to grant him permission to a host of prayers he had made.
To argue his case filed against election of President Uhuru Kenyatta, Orengo requested the court to allow him access to information relayed by IEBC during elections.
Among the issues Orengo wanted to be granted included access to original Form 34A and 34B which he argues that those submitted were forged. He also asked to be allowed access to IEBC severs.
The request was opposed by President Uhuru Kenyatta’s legal team led by Ahmednassir Abdullahi and Fred Ngatia who said the request could alter the case.
And on Monday, the seven bench judge led by Chief Justice David Maraga allowed partial access to IEBC servers with a further directive that IEBC produces original forms for scrutiny.
The latest ruling could twist the direction of the case in which opposition NASA had accused IEBC or allegedly altering forms in favour of President Uhuru Kenyatta.
All information gathered through scrutiny would be tabled before the court on Tuesday evening for further advice by the court.
