Slightly eight months after jointly winning presidential election petition, lawyer Otiende Amollo is among senior counsels who yet again took credit on Thursday in appeals court siting in Niarobi.
Along with James Orengo, Pheroze Nowrojee and Okong'o Mogeni, they had election of President Uhuru Kenyatta nullified by the Supreme Court in September.
Yet again, jointly working with Tom Ojienda and Mathare MP Antony Oluoch, they had an application compelling Homa Bay Governor Cyprian Awiti to deposit Sh20 million as security in appeals court dismissed.
Former Kaspul MP Oyugi Magwanga, who floured Awiti in election petition, through lawyer Charles Kanjama, had filed the application in April this year.
In his ruling, Justice Erastus Githunji observed that the application was inconsistent with the law adding that the court will proceed to make a ruling on the appeal.
"I find the application inconsistent with the law thus I throw it out. The judiciary has specific guidelines on how election petition costs are obtained," he said.
Lawyer Kanjama had argued that depositing Sh20 million would allow Magwanga to recover Sh4 million awarded by he High Court in Homa Bay.
"The application is inconsistent with the law and is a tactic to delay hearing of the main case," Otiende had argued in April.
