Nakumatt lifestyle supermarket in Nairobi.[Photo /Daily nation]The Auditor general Edward Auko now wants legal action to be taken against the Nakumatt supermarket that has been blocking the construction of a 39 Storey building by the national social security fund ( NSSF).

Nakumatt had moved to court in 2014 to block the construction of the additional floors that was to be located above its Nakumatt lifestyle branch citing that the the expansion will negatively affect its operations.

The retail had however claimed to have a 20 year lease agreement with NSSF to carry out its operations from ground, 1st and second floors of the building. 

The building ,Hazina trade towers , which was to be the tallest building in the city has been delayed by the pending court case. 

The NSSF had already hired the Chinese contractors ,China Jiangxi , to construct the 39 floor building that has so far eight floors and with four being occupied by the retail. 

Nakumatt have also blocked the contractors who had already been paid KSh 1.9 billion for the project from reinforcing additional column from the inside of the store. 

“In view of the foregoing, NSSF should take legal action against the tenant to secure completion of the building to safeguard members’ contribution,” said Mr Ouko in NSSF’s latest audit report.

The construction was to run between June 2013 and July 2016.
