National Assembly Speaker Justin Muturi has ruled out the High Court from stopping the National Assembly from debating the ouster of Auditor General Edward Ouko.
Reading the ruling on the floor of the house on Tuesday afternoon, Muturi ruled that the Finance Committee could go ahead and summon Ouko and compile a report for debate before the house.
"Courts have no mandate and it is unconstitutional for the High Court to interfere with the internal processes of the National Assembly as it negates the provisions of Articles 107 and 124 of the constitution. The principle of separation of powers must be upheld," said Muturi.
He added: "It is, therefore, a constitutional affront by the High Court to interfere with the independence given to Parliament by the constitution. The High Court cannot purport to issue rulings to stop a committee of the National Assembly or the assembly itself from debating and determining a matter before it."
The Speaker read various jurisprudences before making his ruling.
The High Court stopped Ouko's removal by the National Assembly. The case will be heard on May 15th.
Ouko had cited unfair process by the Finance committee and the assembly itself saying that decision is pre-determined.
