Anyang’ Nyong’o will have the fate of his term as Kisumu Governor determined in court in his absentia. The judgment on a case challenging his victory in the August 8 elections will be delivered at a time when Nyong’o is still out of the country on vacation.
Kisumu High Court Judge David Majanja is set to deliver the judgment on Wednesday 3, on the matter set before the him four months ago by former Governor Jack Ranguma.
The deputy Governor Mathews Owili on phone confirmed to journalists on Tuesday that the Governor will not be present for the big day in his tenure, and that he will be representing him to receive the judgement.
He said the governor deserved to be away on rest following the rigorous campaigns preceding the August 8, elections and events that proceeded thereafter in other elections.
“I will be present in court to receive the judgment on behalf of the Governor who is away on vacation,” said Owili.
Ranguma in his petition to have the Nyong’o win overturned had accused Nyong’o, an ODM party candidate of colluding withIEBC to rob him of his victory for a second term in office.
He claimed that he won the race by 245, 534 votes against Nyong’o’s 167, 716, as opposed to the declaration by the electoral body which gave Nyong’o a resounding win of 272, 201 votes against Ranguma’s 169, 250.
Ranguma who presented 14 witnesses to substantiate his claims has confirmed that he will be present for the final day of the case.
