Parliament risks being dissolved if it fails to enact the two-thirds gender rule in 60 days.
Constitutional court Justice John Mativo on Wednesday said Parliament has violated rights to equality and women’s freedom against discrimination by failing to enact laws to realize the implementation of the two-thirds gender rule.
Mativo’s ordered the parliament to enact the law in 60 days otherwise, anyone can petition Chief Justice David Maraga to advise the President, Uhuru Kenyatta to dissolve Parliament.
This comes after Centre for Rights Education and Awareness, the Community Advocacy and Awareness Trust and the Kenya National Human Rights Commission filed a case in regard to the same.
Mativo said the courts have a duty to interpret the Constitution, as well as the meaning of laws passed by Parliament.
