The NASA coalition planned establishment of a people’s assembly as declared by Raila Odinga has caused constitutionality questions among Jubilee affiliated politicians who will be working around the clock on how to counter the move.

NASA lawyer and advocate of the high court Willis Otieno links the tact to the reality the country is facing with the camp terming the repeat presidential election as a sham and an illegality.

“You cannot delegate sovereign authority of the people through a minority vote. It is only through the majority vote that can do that. The people have a right to exercise their authority directly or through democratically elected leaders,” said Mr. Otieno.

He stressed on a majority of Kenyans having rejected delegating their power through the October 26 elections and argued that 62 percent of Kenyans had heed NASA calls not to take part in the elections whose outcome NASA coalition has punched holes into.

Mr. Otieno said a minority of Kenyans cannot impose their choice on the majority of the citizen given the elections conducted was not representative of the whole country.

“The majority will now come together and have a national convention on how to have the people coming together to decide how to exercise their sovereignty in a manner respecting and representing the will of the people and it is not a revolution,” said Mr. Otieno.

He further noted that in coming up with a people’s assembly, NASA shall be seeking to have the people exercise their autonomous power directly and that this is constitutionally provided for and remains unstoppable.
