Nyeri Town Member of Parliament Ngunjiri Wabungu has been faulted following his decision to file a petition with the Judicial Service Commission (JSC) seeking the removal of Chief Justice David Maraga from office.

According to an Eldoret-based Lawyer Paul Birech, the decision is ill advised and meant to intimidate the Judiciary.

Speaking at his Eldoret office, Thursday, Birech asked the Jubilee MP to withdraw his petition noting the need for Judiciary to be respected.

He claimed the petitioned is targeting to force the Judiciary to be making decisions that pleases the government of the day.

"This petition from the face of it seeks to have the Judiciary subservient under the arms of government," noted Birech, a former Kenya Red Cross governor.

"If Maraga is removed from office today what will happen to the next Chief Justice? He will be under the control of the executive," he added.

On Thursday, the Nyeri Town MP filed a petition against Maraga seeking his removal from office over what he called 'gross misconduct' following the ruling by the Supreme Court that nullified President Uhuru Kenyatta's win during the August 8 general election.

"We must understand that Maraga does not overturn the will of the people,15 million people.. but he has allowed a clique of people to influence him," Ngunjiri told journalists as quoted by the Star.

"I am challenging his conduct. We have had a lot of judicial issues. What we have is a group of people who have taken captive of the judiciary," he added.
