Eldoret High Court has allowed Bernard Kibor, who was second in Nandi Hills parliamentary seat contest in August 8 elections, to take over a petition challenging Alfred Keter's win.
Kibor, through his lawyer Amos Magut, successfully applied to be considered as a substitute after a voter Joshua Maritim sought to withdraw the case.
Maritim told the court last week that he was no longer interested in the case and that he had been prevailed upon by Nandi Hills residents and his family to withdraw the matter.
While making the ruling on the two applications, Eldoret High Court Judge George Kanyi Kimondo allowed the petitioner to withdraw from the case but also granted Kibor his prayers to be allowed as a substitute.
"My client will now be taking over this petition following the court's decision today and the issues raised will remain the same as had been filed by the original petitioner Robert Kemei who has now withdrawn," said Amos Magut, Kibor's lawyer outside the Eldoret High Court, Thursday.
In the petition, the MP Alfred Keter is accused of campaigning past the set time, voter bribery among others.The status conference for the case will now be held on November 29, 2017, so as to set the hearing date.
