The Kisumu Land and Environment court will on Monday hear a case where Kajulu residents have for a second time moved to court seeking withdrawal of orders that gave a green light for the relocation of Kachok dumpsite.
The petitioners in the case, Titus Achar, Ibrahim Oloo, George Ondere and Rose Juma argue that the locals were never consulted on the relocation exercise adding that that the muck will pose significant health hazard to the citizenry if relocated.
“The Kisumu concrete abandoned quarry pit is next to human settlement, social amenities such as schools and water bodies to be precise Kibos River and Disciple of Mercy Primary School,” the petitioners state.
Those listed in the suit as respondents are the Kisumu City Manager Doris Ambara, the County Government of Kisumu and Naya Holding Limited which is the company awarded the tender to the waste to Kisumu concrete abandoned quarry in Kajulu.
In the case, the Kisumu county government is also accused of flouting public procurement laws.
The petitioners have also expressed concern that the 3rd respondent (Naya Holding Limited) is a construction company and is not licensed to transport waste under the Environmental Management and Coordination regulations.
Another issue the petitioners raised is that the planned relocation site is within 13 Km radius from the Kisumu International Airport (KIA) and falls within the runway and therefore necessitates for an aeronautical study to be carried out as stipulated in the Civil Aviation Aerodromes Regulations 2013 which they claim has not been done.
