High Court Judge L. Kimaru has ruled that the Habeas Corpus case over slain lawyer Willie Kimani, his client and the taxi driver has been spent.
Director of Public Prosecutions (DPP) Keriako Tobiko had in his submission indicated that petition was spent as the deceased’s bodies were recovered, identified and a post-mortem report presented in court.
Law Society of Kenya (LSK) for the petition has been granted leave to amend their petition to set out more elaborate grounds for compensation and to serve the said amended petition within 14 days.
The petition is transferred to the judicial review and constitution division for hearing and determination.
Four senior prosecutors presented the matter on behalf of the DPP namely: Deputy Director of Public Prosecutions Nicholas Mutuku, Senior Assistant Director of Public Prosecutions Alloys Kemo, Assistant Director of Public Prosecutions Catherine Mwaniki and Senior Prosecution Counsel Jemima Aluda.
Lawyer Dr Khaminwa for the petition thanked and acknowledged the fairness and impartiality of the prosecution team in the matter.
