A petitioner in a second suit challenging the relocation of Kachok dumpsite surprised a Kisumu court on Tuesday after he asked for his name to be struck out of the petition.
Ibrahim Oloo, told the court that he could not understand how his name was included among other three petitioners in the suit.
He informed Justice Stephen Kibunjia that he heard his name being mentioned over the radio, as one of the parties who had moved to court protesting against an order that had given the County Government of Kisumu a green light to commence the relocation exercise.
Oloo told the court that he never swore any affidavits related to the case and also expressed his surprise on how a copy of his identity card reached the petitioners advocate’s file.
After a short probe, Justice Kibunjia directed that Oloo’s name be removed from the list of petitioners after it emerged that he had not sworn any affidavits in the case.
He was then told to make a report at the police station so that the person behind the controversy can be apprehended.
The case now remains with three petitioners George Ondere, Rose Juma and Titus Achar.
The three have sued the County Government of Kisumu (first respondent), City Manager Doris Ombara (second respondent) and NAYA holdings limited (third respondent).
In the suit, the petitioners claim that the relocation of the site will be disastrous to the residents of Kajulu where the muck is currently being transported to.
