Four residents from Kisumu East constituency have again moved to the Land and Environment Court to stop the county government from relocating the Kachok dumpsite to Kajulu.
The petitioners Rose Juma Nyanjom, George Onyango Ondere, Titus Achar Okuto and Ibrahim Oloo Onditi wants the court to stop the county from proceeding with the relocation.
The petitioners have listed in the case Kisumu county government as the 1st respondent, City Manager Doris Ombara as the 2nd respondent and Naya holdings which was awarded the contract as the 3rd respondent.
The locals, through their lawyer Moses Omondi, say Kajulu residents risk being exposed to health hazards from the toxic waste that may affect water sources like rivers in the area.
In court documents, they want the county stopped from commencing the transfer of the wastes which had been awarded to Naya holdings at a cost of Sh 99 million since no proper public participation was done.
The matter will come up for hearing on February 19 before Justice SM Kibunja.Just less than two weeks ago, the county government got a temporary reprieve after the high court dismissed a petition that had be filed to stop the process free one of the petitioners withdrew from the case.
