Another court tussle is expected after petitioners who were challenging Kisii County senator Prof Sam Ongeri's win vowed to appeal a Kisii High court's decision to dismiss the case.
The petitioners, George Ogake and Charles Orito, now want the ruling by Lady Justice Winfrida Okwany set aside , terming the judge's decision to ask them pay Sh 8 million as 'inhuman.'
"We have agreed that we have lost the petition but we disagree with Lady Justice Winfrida Okwany's decision that we pay sh 8 Million as costs" said Mr Ogake.
Mr Oriti said that they moved to court as concerned citizens and raising the money will be hard for them.
"How can we raise all that money yet we moved to court to seek justice on what we feel was done wrongly. The order to pay the Sh 8 million raises eyebrows," he said.
Their sentiments come barely minutes after Lady Justice Winfrida Okwany upheld the win of Ongeri for lacking enough evidence.
