Kenyans turned out in large number on August 8 and expressed their will and, therefore, the Supreme Court should be very cautious not to overturn that will unless it is demonstrated that will was subverted.

Independent Electoral and Boundaries Commission (IEBC) Lawyer Prof PLO Lumumba told the Supreme Court judges on Monday that NASA's presidential petition 'suffered from lack of focus and particularity'.

"The totality of our submissions is that we have demonstrated that this petition is destitute of merit. For this reason, it should only suffer one fate, rejection," Tuesday's Daily Nation quotes Lumumba as saying.

PLO described NASA's petition as one that was 'full of hearsay and built on stilts and which must collapse under the weight of evidence'.

"No court in the world has ever voided an election based on the minimalist approach. These are petty grievances. The rule is that he who alleges must prove. What the petitioners have made is allegations but have failed to prove."

He continued: "Kenyans gave birth to a baby. IEBC's role was midwifery. The baby is alive and well. You are being asked to strangle the baby. Decline the invitation," the paper further quotes Lumumba.
