A group of people living with disabilities in Uasin Gishu county has filed an application before an Eldoret court seeking to be exempted from paying the mandatory security deposit.

This is in relation to a case in which they are challenging the process used in selecting Uasin Gishu nominated Members of County Assembly (MCAs).

Through their lawyer Moses Keter, the group argues that they have no ability to pay the sh100,000 required to allow the case to proceed.

"My clients are people living with disabilities and have no ability to clear the security deposit hence the reason we are seeking for that fee to be waived," Keter said in Eldoret on Thursday.

Ruling on the application will be made on January 17, 2018, by the Eldoret Chief Magistrate Charles Obulutsa.

The Magistrate will also be making a ruling on the application in which the nominated MCA's are seeking the petition to be terminated.

Over 300 people living with disabilities in Uasin Gishu County filed a petition at the Eldoret court on September seeking orders to nullify nomination of the 17 nominated MCAs.

They claim the process was not done in accordance with the law and that they have no representation at the County Assembly as required by the constitution.
