Voters Mercy Achieng Mola and John Ndagwa's witness in the case they are challenging the victory of Raphael Wanjala has been arrested and detained at the Busia Police station.This is after he confessed that he was in possession of a Kenyan Identification Card and also participated in the August 8 general elections.The incident came barely 24 hours after another drama unfolded when petitioner's supporters engaged court orderlies in a fist fight protesting an order by Judge Kiarie Waweru to arrest another Ugandan witness Moses Hasede for being in possession of a Kenyan ID.Judge Waweru said the Kenyan ID card should be confiscated for giving false information to the court while being cross-examined by lawyer James Orengo and his IEBC counterpart Henry Kenei.
On Tuesday, Waweru ordered the arrest and detention of Victor Wanyama and investigations launched against his confessions while testifying before action is taken against him.“The witness should be arrested and put in custody for admitting that he acquired a Kenyan national Identification card illegally and even participated in the August 8th General elections by voting at the Port Victoria town hall in Budalang’i constituency,” the judge ordered.Orengo raised concern to the Judge over the disappearance of Hasede who was arrested on Monday by police over similar offense only for him to escape from the security officers in court.Former Budalangi MP Ababu Namwamba's brother Prof Tom Namwamba also testified and was put to task by Orengo during cross-examination.
