A witness in a case where Gatundu South MP Moses Kuria and his Kabete counterpart Ferdinand Waititu are charged with hate speech told a Nairobi court he could not tell who uttered the offending words.

Benson Gicheru, a senior police officer, said he only heard some of the words uttered on June 12 at a function in Kasarani International Stadium but could not tell who uttered them.

The officer, attached to Deputy County Commissioner’s office, told senior principal magistrate Charity Oluoch that he had been deployed to the said function organised by radio presenter Njogu Wa Njoroge as commander of officers who had been assigned to maintain peace.

Another witness, Jackson Chemboi, an Inspector attached to Directorate of Criminal Investigation, Cyber Crime Unit, said he downloaded the clip on the alleged hate speech remarks on YouTube.

The two Jubilee lawmakers are out on a cash bail of Sh2 million each.

They were charged together with six other legislators including those from the opposition.
