A court in Kisumu has released two Administration Police officer accused of murder after prosecution failed to provide sufficient evidence to support their trial.

High Court Judge Davdi Majanja said the two officers could not be held in police remand any further after the complainant in their case failed to prove to court that the two actually were involved in the murder of John Onyonyi.

The officers, Ibrahim Leting and Kibet Lelgo had been accused of beating Mr Onyonyi in Musogo, Muhoroni who later on died at  the Muhoroni sub county hospital in December last year.

According to Judge Majanja, prosecution witnesses failed to identify the two officers in an identification parade to convince the court that they were at the scene where the deceased was beaten and later died in hospital.

"This court has no option but to release the accused for lack f evidence," Majanja said during the court session.

"Prosecution has inadequate evidence to convince the court to sentence the accused."

Onyonyi according to prosecution was beaten by the two officers after a short confrontation in Musogo. The late was seriously injure din the head after the fight a development the complainant claimed had lead to his death.

Most of the prosecution witnesses were Onyonyi's relatives.
