A Maua court established that Joseph Mutua defiled a 13-year-old girl in an incidence that took place in December 2010.

Although Mr Mutua had purported to have married the girl and taken her back to school after the incidence, Resident Magistrate Oscar Wanyaga ruled that the case was unique because of the evidence given in court.

He denied the accused pardon citing that the claim of marriage after committing the offense could only be used in mitigation and not as a point for defence.

Mutua said that at the time of committing the crime, the girl had lied to him that she was over eighteen years and that she had completed high school.

Director of Riples International, an NGO campaigning against sexual offences on girls had earlier taken in the girl and supported her through to giving birth.

The organisation, through Director Mercy Chidi, hailed the ruling and said the case had unfortunately taken six years because police were reluctant to investigate their fellow officer.

Riples also vowed to take care of the defiled minor and her child in case she was unable to do so.
