An investigating officer in a murder case attracted the eye of a magistrate at the Kiambu court with his casual wear when he appeared in court.

Police Constable Dennis Simiyu was not in uniform when he appeared in the dock in a miscellaneous application in which he requested the court for more time to investigate the suspect.

After he swore himself, Kiambu principal magistrate Mr Justus Kituku asked him why he was dressed the way he was.

The officer could not explain convincingly and the magistrate reminded him that he should dress decently whenever he appeared in court as he was still on duty.

The officer told the court that the respondent was arrested on 22nd January 2018 on an allegation of having committed the murder contrary to section 203 as read with section 204 of the penal code.

He noted that the suspect should be detained in police custody.

“There is a likelihood that the respondent will interfere with the evidence of the witnesses," he said.

Mr Kituku, however, allowed the application and set the date for the mention for February 9th, 2018 when the officer is expected to have completed the investigations and either charge him accordingly or release him.
