An appeal has been filed at the Eldoret High Court seeking orders to reverse divorce that was granted to Uasin Gishu controversial farmer and politician Jackson Kibor by a Magistrate court.

Through Lawyer Amos Magut, Kibor's second wife Josephine Jepkoech, filed the appeal terming dissolution of her 51-year marriage as a miscarriage of justice.

According to a memorandum of appeal served to Kibor's lawyers, the ex-wife argues that Kibor in his case failed to proof cruelty noting that the magistrate focused on issues that the petitioner had not pleaded in court like the screaming of the wife in court to make his judgment.

In his ruling on October 6, Eldoret Chief magistrate Charles Obulutsa granted the divorce to Mzee Kibor, 83 saying he had proved the cruelty aspect especially after the wife wailed in court at one time.

"If she could do so in court what about when they are at home," observed Obulutsa in his ruling.In her petition, the wife is seeking the High Court to reverse the divorce and if possible send them back to begin a new hearing in a court other than Obulutsa's.

The High Court is expected to set the date for the appeal's hearing.
