A returning officer on Friday testified in a case challenging the re-election of Changamwe MP Omar Mwinyi.The case was filed in court by Mahmoud Mohamed Ali who wants Mwinyi’s win nullified.In a sworn affidavit, the returning officer, Aisha Abubakar, admitted that polling clerks posed as Jubilee and ODM agents, and signed result forms at one of the polling stations in the constituency. The IEBC official told the court that two clerks signed form 34A on behalf of Jubilee and ODM agents at Chaani Primary School, the Nation has reported.The returning officer, however, said that the matter was recorded in the polling station’s diary. Appearing before Lady Justice Njoki Mwangi, the returning officers also admitted that there were two voters who were issued with more than one ballot papers at Bokole Primary School and Mikandini Primary School polling stations.The officer further said that action had been taken against the clerks.When asked by Ali’s lawyer Gikandi Ngibuini, why the results from the polling station were included in the final tally, the RO termed the move as a mistake.“It should not have been tallied,” said Abubakar.
