A powerful shareholder at betting company Sportpesa has moved to challenge the recent decision by the government to increase the taxation rate on betting companies to 50 percent.
Bradley Limited Trading, alias Pambazuka National Lottery, has now sued Treasury CS Henry Rotich, Interior CS Joseph Nkaissery, Attorney General Githu Muigai and the Betting Control and Licensing Board.
According to the company, Rotich acted in excess of his constitutional powers when he increased their tax burden.
The company further said that the law provides that no tax or licensing fees be imposed or even varied with the only exception that the said variation comes through legislation.
It added that the betting firms were never consulted over the proposal to change the taxation.
Bradley is seeking court orders to rescind the decision on tax increase.
