Calls for the formation of an interim government have attracted President Uhuru Kenyatta.

Kenyatta has responded to a petition by activist Okiya Omtatah seeking for the formation of an interim government before Kenya goes for a fresh presidential election.

In his petition, Omtatah argues that the withdrawal of National Super Alliance (Nasa) presidential candidate Raila Odinga alongside his running mate Kalonzo Musyoka from the October 26 fresh presidential election rendered the poll void since the Supreme Court had asked Uhuru and Raila to face each other once again.

The Independent Electoral and Boundaries Commission (IEBC) and the Attorney-General Githu Muigai have also filed their responses, saying the Supreme Court lacks jurisdiction to handle the petition. They want it dismissed.

In the documents filed on Wednesday, as seen by the Daily Nation, Kenyatta argues that Omtatah's case is an abuse of court process.According to him, Omtatah cannot question his October 26 re-election since he filed the petition even before IEBC declared him a winner on October 30.

“It is common knowledge that the name of Raila Odinga was on the ballot as a candidate in the fresh election. The only inference that can be drawn from this is that IEBC did not receive any valid notice of withdrawal from Nasa,” Jubilee Party Director of Legal Affairs Marykaren Kigen says Kenyatta's affidavit.The three parties appeared before Deputy Registrar of the Supreme Court Daniel ole Keiwua.

Keiwua said the file had been forwarded to Deputy Chief Justice Philomena Mwilu.
