Former Nairobi gubernatorial and Jubilee critic Miguna Miguna has tagged President Uhuru Kenyatta a liar after his acceptance speech at the Bomas of Kenya on Monday.
Mr. Kenyatta was declared President-elect after the fresh polls and during his speech, he revealed why he did not sign the controversial Elections Amendment Bill into law stating he had examined his conscience."When the Bill was brought to me for signature, I was compelled by my conscience to go back to the Origins of Law," stated Uhuru."If an Act of Parliament is a direct expression of the will of the people, were the people happy with this law?"Some argued that I was changing the Rules of Engagement half-way through the game. Others argued to change the electoral law ahead of the 26th election is to privilege me over the other competitors," he continued."Because the law must be founded on reasoned national consensus, I listened to these voices. I did not sign the new Bill into Law," he added.However, Miguna, while speaking on NTV on Tuesday morning, explained that by operation of law, the amendment became law last week and Kenyatta "should stop lying to the nation"."It had been passed by Parliament, sent to him and he did not reject it. By him doing nothing it became law.It is just awaiting gazettement," explained Miguna.According to article 115 of the Constitution of Kenya, if the President does not assent or propose changes to a bill, it becomes law after 14 days, subject to gazettement."If the President does not assent to a Bill or refer it back within the period prescribed in clause (1), or assent to it, the Bill shall be taken to have been assented to on the expiry of that period," reads the Constitution.
