A presidential election petitioner Caleb Mamaya whose application was recently dismissed by the Supreme Court Judges has announced plans to sue Chief Justice David Maraga.
Wamaya still maintains that the bench abused his rights by refusing to enjoin him in the case, whose verdict came out on Monday upholding the election of President Uhuru Kenyatta.
He said that he will be filing a complaint against Maraga with the Judicial Service Commission.
He noted that he followed the right procedure to file the petition at the Supreme Court and wondered why the Judges went ahead and dismissed it.
“My application was authenticated by the Supreme Court Registrar and I was given the green light to go ahead and pay the fee. Now all that money went into waste as my application was knocked out,” he said.
Addressing a press conference in Kisumu on Wednesday upon arriving in Kisumu, Wamaya said the decision to strike out his petition was pre determined.
He said he filed the application against all odds and alleged that he learnt earlier that his application had been thrown out even before Justice Maraga made the announcement.
Justice Maraga had last week told the petitioner to seek audience with his area MP to grant the court more time to hear such time sensitive petitions.
