Political analyst Mutahi Ngunyi of the 'tyranny of numbers' fame has dismissed NASA's plans to create a prime minister's post through a referendum terming it unconstitutional.

Mutahi has also said that the NASA principals being promised the same are being taken for a ride by their colleagues.

"Article 255 of the constitution has listed the 9 things that require a referendum and the structure of the national executive at article 130 is not one of these things. So creating the position of a Prime Minister through a referendum is unconstitutional in my view. Promising Kalonzo and Mudavadi these positions after the elections is also a stinking con. It will not happen," Ngunyi says on his YouTube channel, The Fifth Estate.

He notes that the results of such an arrangement among NASA co-principals will be like the botched 2002 MOU between Kibaki and Raila.

"It is another fake MOU like the one between Kibaki and Raila in 2002.

According to Article 256, however, the position of Prime Minister can be created through a 2/3 majority in parliament. This can happen in the next 3 months if we want to do so. And because both Jubilee and NASA need this position, it will garner the necessary 2/3 majority in my view. And then Uhuru can offer the position to Kalonzo, Mudavadi or even Raila Odinga you never know," he adds.
