The National Super Alliance (NASA) risks losing its title, even as it continues to popularise itself for the August 8, polls.
This is after the Northern Advocacy for Sustainable Agriculture (NASA) filed an application in Court, demanding that the Registrar of Political Parties, Lucy Ndung'u be restrained from registering Nasa (the alliance), as a political party.
The alliance is a unity (agreement) between ODM party (Raila Oding), ANC (Musalia Mudavadi), Moses Wetangula (Ford Kenya) and Wiper Democratic Movement (Kalonzo Musyoka), with aim to form Kenya's fifth government. According to the agricultural organisation, its title 'Nasa', exists in the files of the Non-Governmental Organisation (NGO) Co-ordination Board, and was registered before the Opposition came up with similar title.
Through its lawyer Sam Ogutu, the organisation said it was registered and received certificate August 29, 2016.
Under a certificate of urgency, the organisation wants a declaration that it has sufficient legal rights over the name and acronym, NASA.
Ogutu said they are entitled to enjoy its (NASA) exclusive use and operations to the exclusion of the (NASA, the politicians), their servants or any person claiming through them.
“This Honourable Court be pleased to issue an interim injunction against the first defendants (National Super Alliance), their agents or servants to restrain them from the use of the word or acronym ‘NASA’ as the official or unofficial names of the political party or intended political party for any reason whatsoever pending hearing and determination of the application inter partes,” read part of the petition, Friday, as quoted by Capital Fm.
The Organisation now wants the High Court to issue a declaration that only they, can use the acronym ‘NASA’, and a guarantee that the politicians will be forced to look for another name. The agricultural organisation, which primarily operates in Northern Kenya, has also complained that since the Opposition leaders came together use the name, its revenues had dropped because donors were hesitant to fund a body with ties to a political party.
