It is now official that NASA presidential candidate Raila Odinga and his running mate Kalonzo Musyoka will not take part in the repeat presidential poll which is scheduled for October 26 as ordered by the Supreme Court.
In a press conference on Tuesday, the coalition blamed the IEBC of allegedly disregarding the recommendations by the Apex Court which nullified the August 8 presidential poll.
Further, the outfit blames the Jubilee coalition planning to introduce new election laws through Parliament which they claim is meant to give the ruling party an upper hand in the next poll.
However, based on the 2013 Supreme Court ruling, the IEBC is supposed to conduct fresh election in an event one candidate withdraws from the race or dies. This therefore means that as per that ruling, the Wafula Chebukati-led IEBC will have to conduct fresh nominations and conduct election within 90 days.
"As per a correction issued on 6 May 2013, the Supreme clarified that the relevant article is above is 138 (8) (b) which deals with cancellation of a presidential election in the event of the death of the president or the deputy on or before scheduled date. The Supreme Court finding expanded this clause to include when a candidate withdraws from the presidential election," read part of NASA statement.
