Nasa presidential candidate Raila Odinga has given the Director of Public Prosecutions a 72-hour ultimatum to charge IEBC officials said to have led to illegalities in the August 8 polls.
The issue has been the topic of discussion in recent weeks, with the opposition legal minds saying people have to take responsibilities for their mistakes.
"Following that decision, your office has made a statement that it will evaluate the full text of the Judgment and make a determination on whether or not to commence and proceed with criminal prosecutions,” read part of the statutory notice written to the DPP.
“Our express instructions are that the commissioners and members of the secretariat not only committed criminal acts of which they should be held personally responsible, but also aided and abetted the commission of offences under the Elections Offences Act, the Public Procurement Act, the Elections Act and breaches of the Constitution," added the notice.
The coalition has insisted that all those found culpable of wrong doing which could have led to the nullification of the election should be charged.
Further, the opposition has insisted that they will not participate the October 26 election if their demands, which include change at the electoral body, will not be met.
Some of the officials that the coaltion wants charged include Chairman Wafula Chebukati, CEO Ezra Chiloba and ICT director James Muhati, Immaculate Kassait, Molu Boya, Abdi Guliye and Marijan Hussein.
