National Super Alliance (NASA) leader Raila Odinga has failed to comply with a court order where he was directed to respond to a petition filed in the High Court to compel him to participate in the repeat presidential election.
Justice Chacha Mwita had last week ordered Raila and Wiper Leader Kalonzo Musyoka to respond to a case filed by Pokot South Member of Parliament David Pkosing.
Pkosing had told the court that neither Odinga nor his lawyers had filed submissions despite having been served with the court.
By Monday, the NASA leaders had not filed their responses neither did they send a lawyer to represent them in court.
The case proceeded as Justice Mwita heard arguments without the participation of the opposition leaders.
During the hearing, the petitioner argued that the withdrawal threats by the opposition coalition would create a constitutional crisis in the country.
