According to Cord leaders Raila Odinga and Kalonzo Musyoka, the outgoing Independent Electoral and Boundaries Commission (IEBC) commissioners must stop conducting any IEBC business since they are in office illegally.

In a press briefing at Capitol Hill on Thursday, Raila and Kalonzo accused the Hassan-led commission of continuing to carry out business even after the law removing them from office was enacted.

“The retired commissioners must stop any activity or engagement in the name of IEBC forthwith and new commissioners must assume office on or before 23 December 2016,” Kalonzo said.

He added Hassan and his team are in office illegally since the new law has been passed to create a seven-member commission as opposed to theirs that has nine

“The Election Laws (Amendment) Act, 2016 only provides for a Commission consisting of seven members and there are no transitional provisions enabling the Commissioners to remain in office as constituted prior to the enactment of the statute,” he said.
