NASA leader Raila Odinga may face prosecution for disobeying and actively working to obstruct Supreme Court orders from being implemented. When nullifying President Uhuru Kenyatta’s big victory, the Supreme Court ordered a fresh presidential election be held within 60 days. The Jubilee side has fully complied with the court orders, despite disagreeing with the ruling, while NASA has been doing the opposite. Already, Jubilee secretary general Raphael Tuju has filed a petition at the Supreme Court, in which he accuses Raila and the NASA coalition of disobeying the court orders and using the court for political expediency without regard to the rule of law. "[NASA] are the ones who approached this honourable court for orders directing the IEBC chair to hold fresh elections," reads part of the petition, as quoted by The Star."The applicant is apprehensive that [NASA leaders] will continue with actions aimed at ensuring that the orders of this honourable court are not implemented and irreparably prejudice the other candidates in this matter and the people of Kenya as a whole,” Tuju adds. Raila has already declared October 26, the day of the presidential rerun, the date when NASA supporters will hold “mother of all demonstrations”. Everyone knows that this is a plot to violently disrupt other Kenyans who will be exercising their democratic right of electing their leaders. In Kenya, no one is above the law. Raila should not be let to go away freely when he is trampling the rights of others. Now that he has pulled out of the race, although he did not officially sign the required form, he should let the people of Kenya choose their next president freely.
