[Photo: the-star.co.ke]NASA leader Raila Odinga's petition has suffered a setback after the Supreme Court dismissed an application by NASA to have documents filed beyond the allowed time by President Uhuru Kenyatta struck off.Delivering the ruling on Sunday, Justice Smokin Wanjala said that the decision had been reached 'in the interest of justice'.“In the interest of justice to all, we are inclined to invoke our inherent jurisdiction in favour of retaining the documents and annexures in question on the court record. The motion is, therefore, hereby dismissed,” said Wanjala.This was even as the court allowed Attorney General Githu Muigai and the Law Society of Kenya (LSK) to participate in the presidential petition as friends of the court.The court, however, said the AG will only be allowed to file an affidavit on one issue relating on the finality of presidential election results announced and declared at the constituency level.“We notice that quite a number of issues the Attorney General wishes to address us on are already covered by counsel who are appearing in this matter,” Supreme Court President Justice David Maraga said.Applications by lawyer Charles Kanjama and the Information Communication Association (ITCA) were,however, disallowed.Kanjama’s application was dismissed on the basis that he does not possess sufficient expertise on technological issues.Nevertheless, the court allowed August 8 presidential candidates Ekuru Aukot and Michael Wainaina to be enjoined in the case as interested parties.
