[Photo/Raila Odinga]ODM Director of Communications Philip Etale has dismissed reports that NASA leader Raila Odinga will not be sworn-in as president Tuesday.Earlier, Nasa foot soldiers maintained that their leader would be sworn-in as president on Tuesday during swearing-in of President Uhuru Kenyatta.NASA secretariat CEO Norman Magaya said plans were underway to ensure the former prime minister takes an oath of office.Raila has however remained tight-lipped about the controversial matter. On Friday evening, Raila said NASA would hold a mourning ceremony at Jacaranda Grounds in honour of NASA victims who were killed by the police a week ago during his welcoming from the US.There have been reports that Raila had declined to be sworn-in in fear of his international reputation. However, on Sunday, Etale dismissed the reports, saying Odinga must be sworn-in."FORGET newspaper HEADLINES. FORGET so called 'sources close to BABA'. FORGET govt propaganda through sections of the media. FORGET any DIVERSIONARY tactics by Jubilee and their AGENCIES... The resolve by the PEOPLE of Kenya is one... BABA MUST BE PRESIDENT." Etale said on Twitter.According to Article 141 of the 2010 Constitution, the swearing in of the President-elect should be in public before the Chief Justice, or in the absence of the Chief Justice, the Deputy Chief Justice. If someone else swears themselves in as president, it amounts to treason. If Raila swears himself in, in case he repeats the oath of office that Uhuru will take, by saying the exact words, he risks being charged with treason and if convicted, the penalty is death by hanging according to Jubilee MP Moses Kuria.
