Today midnight is the deadline for NASA leader Raila Odinga to file any petition at the Supreme Court challenging the election of President Uhuru Kenyatta in the repeat presidential election.
In the repeat poll that NASA leader Raila Odinga boycotted, IEBC chairman Wafula Chebukati declared President Uhuru Kenyatta winner after garnering 7.4 million votes that amounted to 98 per cent of the total votes cast.
If no one files a petition, the Constitution provides that Uhuru be sworn in on the first Tuesday following 14 days after the October 30 declaration by IEBC.
Article 141(2) of the Constitution says: "The President-elect shall be sworn in on the first Tuesday following - (a) the fourteenth day after the date of the declaration of the result of the presidential election, if no petition has been filed under Article 140."
In case of an unsuccessful presidential election petition, Uhuru could be sworn in on November 28.
"The President-elect shall be sworn in on the first Tuesday following - (b) the seventh day following the date on which the court renders a decision declaring the election to be valid, if any petition has been filed under Article 140," the Constitution states.
If one files a petition today, the Supreme Court has until November 20 to render its decision.
However, a successful petition could stretch events to January next year.
