A case filed by a Jubilee loser challenging Kemera ward results has been dismissed by Keroka Law Courts with the petitioner slapped with costs.
Ex-Kisii Mayor Alloys Moseti had moved to court to challenge election of Wiper's George Morara as duly elected MCA.
A judgment delivered on Tuesday by resident Magistrate B.M Kimtai rendered the case defective citing lack of 'sufficient' evidence.
"The petitioner's case fails to substantially prove illegalities and irregularities and I therefore render it defective.
"The court further directs the petitioner to pay all costs incurred in the entire proceedings as required by the law," read part of the judgment.
Raila Odinga's NASA has been winning election petitions with Taita Taveta Governor Granton Samboja and Tana River's Dhadho Ghodhana being among notable winners.
Morara, who is serving his first term, lauded the judgment further claiming that Jubilee might also lose more cases in Nyamira.
"We all know Nyamira is a NASA zone and even some elected members on Jubilee whose victories were challenged may lose their seats," he said.
