[Photo: Nairobi Wire]NASA is playing 'ping-pong' game with the law, the same thing it has accused the Independent Electoral and Boundaries Commission (IEBC) of playing with them.High Court Advocate Charles Kanjama has said that Nasa is engaging in a high stakes game because 'if they are wrong then Uhuru Kenyatta is sworn in as President'.However, Kanjama speaking to NTV on Tuesday evening added, If Nasa has correctly interpreted the constitution, 'Kenya will need new nominations before we have a new election'.This was, nevertheless, refuted by Political analyst and former magistrate Joy Mdivo who said that IEBC have until November 1 to conduct a fresh presidential poll after which the electoral agency will have no legal basis to call for an election."The painless way out of this situation is to go on and organise for the election. Even if people do not turn up but the systems are at the polling stations, the election would have taken place," Mdivo said.Dr Lukoye Atwoli, a Sunday Nation columnist and senior Moi University lecturer, argued that If IEBC 'bullishly' follows the law, the country will have an election on October 26."The law has a clear procedure on withdrawal of candidature which in my opinion Raila Odinga hasn't followed. So, an October 26 election can be legal but lack legitimacy. IEBC must be more creative in dealing with this political crisis without being legalistic," Lukoye stated.
