Government chief legal adviser has warned NASA leader Raila Odinga against take an oath of presidency.
Attorney General Githu Muigai said the opposition chief is being misled by 'have been' lawyers about the move.
Speaking on Monday, the AG told Raila doing so is wishing death because it is high treason.
Treason is punishable by death under Kenyan law.
"Some senator says there is nothing like treason law, that it is colonial law. This is a man sitting in the Senate? The essence of the law of treason is to protect constitutional order, a lawyer who says they’ve practiced for forty years and there’s no law to protect the Constitution from illegitimate overthrow belongs in another forum,” Githu said.
He slammed at NASA lawyers terming them as ignorant.
One fellow said the Attorney General should never comment on criminal law as the role of criminal justice is the Director of Public Prosecutions. This is ignorance on stilts. The AG is chief legal adviser of the government, and defender of rule of law; all law, including criminal justice,” said Prof. Muigai.
“They comment on every public issue. The more ignorant they are on the subject matter, the louder they will comment in the media and on social media websites. They never seem to keep their mouths shut on issues they have no idea about,” he added.
NASA senator James Orengo has been pushing Raila for the swearing in saying there is nothing like treason.
