[Photo: NMG]Raila Odinga's withdrawal from the presidential race is immaterial and won't affect the October 26 repeat polls.Kikuyu MP Kimani Ichung'wa has said that there is no vacuum in law that can make the country slide into a constitutional crisis as lawyers and constitutional experts have been saying.Ichung'wa, speaking at Parliament buildings on Tuesday after Raila announced his withdrawal, said that Raila is supposed to have withdrawn three days after nominations in accordance with the electoral law."I beg to differ with those saying that the country will be plunged into a constitutional crisis because the law is clear. Now that Raila has withdrawn after the elapse of the mandatory 3 days following nominations, President Uhuru Kenyatta who was the only competitor, should be declared as elected unopposed," said Ichung'wa.He said the IEBC should save Kenyans the billions of shillings it has put on line ahead of the repeat poll, as it did in his case (Kikuyu Constituency) where he was declared as elected unopposed and, therefore, no MP elections were conducted in the area on August 8.However, Lawyer and Governance Expert Brian Mutie speaking separately to Citizen TV seemed to differ with Ichung'wa saying that the withdrawal Raila from October 26 polls enters Kenya into 'uncharted legal waters'."There is no clear legal way out of the political crisis we are in now because the constitution and all the existing laws do not come clear on the path that should be taken in such circumstances. I think the only way out, is a political brokered process," Mutie said.
