Activists in Mombasa have asked the Deputy Chief Justice Kalpana Rawal to vacate office at the age of 70.

The activists said the move will help Rawal avoid court cases that may further taint the name of the Supreme Court.

Hussien Khalid, the director of Haki Africa, a civil society group based in Mombasa, said that the deputy chief justice should be in the fore front of protecting the Constitution.

“It is not right for Supreme Court judges who should be protecting the Constitution to be the ones going against it and contesting some clauses,” said Khalid.

He also noted that Deputy CJ Kalpana Rawal and Judge Philip Tunoi should follow in the footsteps of Chief Justice Willy Mutunga who offered to retire before his term in office elapsed.

Mr Khalid also said that it was not in the best interest of the country for the judges to engage in legal battles concerning matters that were already stipulated in the Constitution.
