Nakuru businessman Geoffrey Asanyo is demanding more than Sh14 million from Nakuru County governor and Nakuru Water Services and Sanitation Company (Nawassco).
The businessman is demanding the money after he won a constitutional petition at the Nakuru industrial court reinstating him as board director at the water firm.
Asanyo, whose lawyer is back in court with Governor Kinuthia Mbugua and Nawassco, filed a certificate of bill of costs worth Sh14,270,272. Asanyo’s lawyer, Kipkoech Ngetich, had filed a bill of cost certificate worth Sh33 million before the deputy registrar reviewed the amount and reduced it to Sh14 million by taxing off over Sh19 million.
The reinstated board director has already procured an auctioneer agency to execute the decree by auctioning Nawassco properties, prompting the governor and Nawassco to seek stay orders in court.
Steve Osur, for advocate Tom Ojienda, filed a reference before taxing officer Nyakundi Maroro, requesting to cite reasons for the taxation at the amount claiming the suit was a simple industrial dispute.
But laywer Kipkoech maintained the decree has been issued by the court and is due for execution arguing the petition, filed on March 20, was not ordinary but constitutional.
Tom Ojienda, who represented the respondents, had lodged an appeal at the high court seeking for stay orders against execution of the decree but the court dismissed the appeal.
